Certain Services use artificial intelligence (“AI”), machine learning systems, automation workflows, retrieval systems, and third-party AI providers to generate responses, outputs, insights, summaries, recommendations, or other content.AI-generated outputs:may contain inaccuracies or omissions;may not always be complete, current, or suitable for your intended purpose; andare provided for informational purposes only.AI-generated content does not constitute legal, financial, investment, medical, or professional advice.You remain solely responsible for:reviewing outputs;validating information;making decisions based on outputs; andensuring lawful use of generated content.Any reliance on AI-generated outputs is entirely at your own risk.
6. User Content, Inputs and Outputs
You retain ownership of any prompts, files, documents, text, data, materials, or other content submitted to the Services (“User Content”).By submitting User Content, you grant Vibrancy.ai a limited, non-exclusive licence to host, process, store, transmit, analyse, and use such content solely for the purpose of:operating the Services;maintaining security;improving functionality; anddelivering requested outputs.Subject to applicable law and third-party provider restrictions, you retain ownership of outputs specifically generated for you through the Services based on your User Content.You are solely responsible for ensuring that:you possess the necessary rights and permissions to submit User Content;your use of the Services complies with applicable laws; andsubmitted content does not infringe intellectual property, privacy, confidentiality, or other legal rights.You must not submit:unlawful content;malicious code;deceptive material; orhighly sensitive personal information unless explicitly authorised by us in writing.

To the fullest extent permitted by law, Vibrancy.ai shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including:loss of profits;loss of revenue;loss of goodwill;business interruption;loss of data; orloss of anticipated savings,arising from or relating to the use of the Services.Our total aggregate liability arising out of or relating to the Services shall not exceed the total amount paid by you to Vibrancy.ai during the twelve (12) months preceding the event giving rise to the claim.Nothing in these Terms excludes liability which cannot lawfully be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Vibrancy.ai, its directors, officers, contractors, affiliates, and partners from any claims, liabilities, damages, costs, or expenses arising from:your use of the Services;your User Content;your breach of these Terms; oryour violation of applicable law or third-party rights.
14. Privacy
Your use of the Services is also governed by our Privacy Policy.By using the Services, you acknowledge that personal information may be processed in accordance with our Privacy Policy.
15. Termination
We may terminate or suspend your access to the Services immediately where:these Terms are breached;payment obligations are not met;misuse or security concerns arise; orrequired by law.Termination does not affect accrued rights or liabilities.Sections relating to liability, intellectual property, indemnities, governing law, and dispute resolution shall survive termination.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.The courts of England and Wales shall have exclusive jurisdiction over disputes arising from these Terms or the Services.
17. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any additional written agreements expressly incorporated by reference, constitute the entire agreement between you and Vibrancy.ai regarding the Services.
